These Terms of Use (“Terms”) govern your access to and use of the Haya AI Platform website, platform, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
1. About Haya
Haya provides an AI-supported informational and guidance tool for parents, legal guardians, and caregivers of children with autism, Down syndrome, and other developmental or neurodivergent needs.
Haya is designed to help users organize information, think through everyday situations, and access supportive content.
Haya does not provide medical diagnosis, treatment, psychotherapy, crisis intervention, or emergency services.
Use of Haya does not create a doctor-patient, therapist-patient, attorney-client, or other licensed professional relationship.
2. Eligibility
You may use the Service only if:
- you are at least 18 years old, and
- you are using the Service for lawful purposes, and
- where you provide child-related information, you are authorized to do so.
Haya is intended for use by parents, legal guardians, and caregivers. It is not intended for direct use by children.
3. Permitted Use
You may use Haya only for lawful, personal, family, caregiving, or related support purposes.
You may not use the Service:
- for unlawful, harmful, abusive, fraudulent, or misleading purposes
- to infringe the rights of others
- to upload malicious code or interfere with the Service
- to probe or test vulnerabilities without authorization
- to rely on the Service as a sole source for diagnosis, treatment, or emergency decision-making
- to submit content that you do not have the right to provide
4. Important Health and Emergency Limitation
Haya is not a medical provider and does not replace physicians, psychologists, therapists, behavioral professionals, school teams, emergency responders, or other licensed professionals.
If there is a medical emergency, psychiatric crisis, risk of harm, suicidal thoughts, self-harm risk, or danger to a child or another person, do not rely on Haya. Contact local emergency services or an appropriate licensed professional immediately.
5. AI Responses and No Guarantee
Some responses are generated or assisted by AI systems.
AI-generated responses may be incomplete, inaccurate, outdated, generalized, or unsuitable for a particular situation. You are responsible for evaluating information provided through the Service and for decisions made based on that information.
We do not guarantee that the Service or any response will be accurate, complete, reliable, or appropriate for your needs.
6. User Responsibility
You are responsible for:
- the information you choose to provide
- the accuracy of content submitted by you
- ensuring that you have authority to provide child-related or third-party information
- your decisions and actions taken based on the Service
You should use your own judgment and, where appropriate, consult qualified professionals.
7. Accounts
If account registration is available, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to notify us promptly if you suspect unauthorized use of your account.
8. User Content
You may submit content through chats, forms, feedback, or other features of the Service.
You retain rights in your content to the extent provided by law. By submitting content, you grant us a non-exclusive, limited right to use, host, process, store, and display that content as necessary to operate, maintain, secure, improve, and provide the Service, subject to our Privacy Policy.
You represent that you have the right to provide any content you submit.
9. Intellectual Property
The Service, including its design, text, software, branding, graphics, and related materials, is owned by Haya or its licensors and is protected by applicable intellectual property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from the Service.
10. Service Changes and Availability
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
We do not guarantee uninterrupted or error-free availability of the Service.
11. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.
We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
12. Limitation of Liability
To the maximum extent permitted by law, Haya and its affiliates, founders, officers, employees, contractors, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, opportunities, or business interruption arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability arising out of or related to the Service shall not exceed the amount paid by you, if any, to Haya for the Service in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.
13. Indemnity
You agree to indemnify and hold harmless Haya and its affiliates, officers, employees, contractors, and service providers from and against claims, damages, liabilities, losses, and expenses arising from:
- your misuse of the Service
- your breach of these Terms
- your violation of applicable law
- your submission of content without proper rights or authority
14. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, created risk for users or systems, or used the Service unlawfully.
You may stop using the Service at any time.
15. Privacy
Your use of the Service is also subject to our Privacy Policy.
16. Governing Law and Jurisdiction
These Terms shall be governed by the laws of the State of Israel, without regard to conflict of law principles.
The competent courts in Tel-Aviv, Israel shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.
17. Changes to These Terms
We may update these Terms from time to time. If we do, we will update the date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
